Cougar Club Member Agreement and Payment Authorization

By enrolling in a Cougar club, I confirm that I am at least 21 years old and authorize Cougar Vineyard & Winery to keep my payment method on file and charge it according to the billing schedule of my selected membership.

I acknowledge that I have reviewed the commitment, billing, cancellation, fulfillment, and benefit terms that apply to my selected club. I understand that processed charges are nonrefundable except where required by law.

General Membership Terms

Payment Authorization

I authorize Cougar Vineyard & Winery to charge my payment method for scheduled club payments, wine selections, membership fees, applicable taxes, shipping charges, and additions or changes I authorize.

I agree to maintain current payment, contact, billing, and shipping information.

If a scheduled payment is declined, Cougar may retry the payment and place my membership benefits on hold until the account is brought current.

Members and Guests

Wine club members must be at least 21 years old.

A membership may have up to two named members when both members reside at the same physical address. Only named members may make account changes or use membership benefits unless a specific benefit allows sharing with guests.

Cougar reserves the right to request identification before providing age-restricted products or benefits.

Written Notice

All cancellations, pauses, shipment skips, swaps, fulfillment changes, and account changes must be submitted in writing through one of the following methods:

• Email to wineclub@cougarvineyards.com

• Postal mail

• A signed request delivered in person

An email request is effective when sent. Postal notice is effective when delivered. An in-person request is effective when signed and delivered to Cougar staff.

Phone calls, text messages, and verbal requests made to servers or other staff do not constitute written notice.

Cougar will provide confirmation after processing a request. Members should contact the Wine Club office if they do not receive confirmation.

Quarterly Wine Club Terms

These terms apply to the 2-Bottle, 4-Bottle, and 6-Bottle Quarterly Wine Clubs.

Activation and Minimum Commitment

An initial qualifying wine purchase activates a new 4-Bottle or 6-Bottle membership. The activation purchase does not count toward the required shipment commitment.

By joining a Quarterly Wine Club, I agree to purchase at least three quarterly shipments after activation.

The 2-Bottle Club is closed to new memberships but remains active for existing members.

Quarterly Billing Schedule

The card on file is charged on the Monday before the second Wednesday of the applicable selection month.

• 4-Bottle Club: January, April, July, and October

• 6-Bottle Club: February, May, August, and November

• Legacy 2-Bottle Club: March, June, September, and December

The amount of each order varies according to the selected wines, additions, applicable taxes, and shipping charges.

Processed quarterly orders are nonrefundable.

Selections and Changes

Replacement wines must be of equal or greater value. Members may also exchange two or more lower-priced wines for a higher-priced wine and are responsible for any resulting price difference.

Ship-to members must complete online swaps or submit written changes by close of business on the Sunday before billing.

Will Call members may swap wines at any time, including on the day of pickup.

Members may change between Will Call and shipping by providing written notice by close of business on the Sunday before billing.

Will Call and Shipping

Will Call orders become available on the second Wednesday of the selection month.

Shipped orders generally leave the following Monday, or Tuesday when Monday is a carrier holiday.

Uncollected Will Call orders remain at the winery until the member collects them or requests shipping. The original wines, vintages, and varietals are guaranteed for 45 days. After 45 days, an unavailable wine may be replaced with a comparable selection.

Members requesting shipment are responsible for the shipping charges applicable to their selected club and order.

Wine cannot be shipped to a P.O. box or to a location where direct wine shipment is prohibited. Every wine shipment requires an adult signature from someone age 21 or older.

Members are responsible for providing a correct deliverable address and for carrier charges resulting from an incorrect address, missed delivery, rerouting, return, or reshipment.

Skipping a Shipment

A member may request to skip a quarterly shipment by providing written notice at least 30 days before the applicable billing date.

A skipped shipment does not count toward the three-shipment minimum commitment.

Cancellation

A member may cancel after completing the three-shipment minimum by providing written notice at least 30 days before the next billing date.

A $75 cancellation fee applies if:

• The membership is canceled before three quarterly shipments have been completed; or

• The required 30-day written notice is not provided.

Cougar Den Subscription Club Terms

Monthly Payment Authorization

The card on file is charged $60 when the member joins. The first payment is credited to the member’s Cougar account, and membership begins immediately after the payment is successfully processed.

After enrollment, the card on file is charged $60 on the first day of each month. Each successful payment is credited to the member’s Cougar account.

By joining, I agree to complete a minimum of 12 monthly payments.

Monthly payments are nonrefundable once processed.

Account Balance

Unused account funds roll over from month to month, do not expire, and remain available indefinitely.

Account funds may be used only by a named member or while a named member is present. The balance cannot be transferred to another person, redeemed for cash, or refunded.

If the membership is canceled, the remaining balance continues to be available indefinitely. Membership discounts end when the membership ends, and the remaining balance is applied to future purchases at regular retail prices.

Declined Payments

If a monthly payment is declined, membership discounts and complimentary benefits are placed on hold until the account is brought current.

A member whose benefits are on hold may continue using funds already available in the account balance.

Pausing a Monthly Payment

A member may request to pause or skip a monthly payment by providing written notice at least two weeks before the next charge.

A skipped payment does not count toward the 12-payment minimum commitment.

Cancellation

A $75 early cancellation fee applies if the membership is canceled before completing 12 monthly payments.

After completing the 12-payment commitment, a member may cancel without a cancellation fee by providing written notice at least 30 days before the next monthly charge.

Cask Club Terms

Payment and Term

The Cask Club is a prepaid three-year membership.

The full membership price of $540, plus any applicable taxes, is charged when the member joins. The three-year term begins on the enrollment date.

The payment is nonrefundable, and the membership cannot be transferred.

The membership does not renew automatically. A member may choose to renew at the price and under the terms offered at that time.

Wine Allotments

Wine allotments become available according to the schedule described on the Wine Club page.

Unclaimed allotments roll over indefinitely and remain available after the active membership term ends.

Shipping is charged at the carrier rate and requires an adult signature.

End of Membership

Membership discounts, complimentary benefits, and event privileges end after three years unless the membership is renewed.

Cask Club membership does not include ownership of an oak barrel.

Barrel Club Terms

Payment and Term

The Barrel Club is a prepaid three-year membership.

The full initial membership price of $1,400, plus any applicable taxes, is charged when the member joins. The three-year term begins on the enrollment date.

The payment is nonrefundable, and the membership cannot be transferred.

The membership does not renew automatically.

Wine Allotments

Wine allotments become available according to the schedule described on the Wine Club page.

Unclaimed allotments roll over indefinitely and remain available after the active membership term ends.

Shipping is charged at the carrier rate and requires an adult signature.

Renewal

A member may renew for another three-year term instead of collecting the empty barrel.

The current renewal price is $995 but is subject to change. Renewal is optional and must be affirmatively selected by the member.

Barrel Ownership and Pickup

At the end of the membership term, the empty barrel belongs to the member unless the membership is renewed.

The member must provide at least two weeks’ written notice before collecting the barrel. Until Cougar receives a pickup request and the required preparation notice, Cougar may continue using the barrel for winemaking.

The member is responsible for collecting the barrel or arranging and paying for its shipment.

Membership discounts, complimentary benefits, and event privileges end after three years unless the membership is renewed.

K9 Club Terms and Liability Waiver

Payment and Term

The K9 Club is a one-year membership assigned to one specific dog.

The annual membership price is:

• $50 when the dog’s guardian is a current Cougar wine club member

• $55 when the dog’s guardian is not a current Cougar wine club member

The full amount is charged at enrollment. The one-year term begins on the enrollment date.

The payment is nonrefundable and is not eligible for a prorated refund. Membership cannot be transferred to another dog and does not renew automatically.

Each dog requires a separate membership.

Health and Conduct Requirements

By enrolling a dog in the K9 Club, the guardian confirms that the dog:

• Has current Rabies, Distemper, Parvo, and Bordetella vaccinations

• Is in good health and free of ticks and fleas

• Behaves non-aggressively toward people and other dogs

• Complies with applicable licensing requirements

• Wears a collar and identification tag containing the guardian’s current contact information

• Remains leashed while on Cougar property

Proof of vaccination is not required at enrollment. By accepting this agreement, the guardian represents that the required vaccinations are current.

There is no minimum age for participating dogs. Retractable leashes are permitted, provided they are used responsibly and kept at a reasonable length so the guardian maintains control of the dog at all times.

Guardian Responsibility and Assumption of Risk

The guardian accepts responsibility for the dog’s conduct, supervision, injuries, and property damage.

Participation may involve interaction with people, animals, food-service areas, outdoor terrain, and other ordinary winery risks. The guardian voluntarily accepts these risks on behalf of themselves and the enrolled dog.

Cougar is not responsible for lost, stolen, or damaged personal property belonging to the guardian or dog.

Cougar may require a disruptive, unsafe, ill, or aggressive dog to leave. Cougar may suspend or terminate a K9 membership for violations of health, conduct, or safety requirements without issuing a refund.

Event Reservations and No-Shows

Event invitations are subject to capacity and do not guarantee admission. Members must RSVP by the published deadline.

Pickup-party reservations must be canceled in writing by the Sunday before the party.

A $6 no-show fee applies to each reserved complimentary member spot that is not canceled by the deadline.

Additional paid guests are currently $9 per person. Guest payments are nonrefundable after the Sunday cancellation deadline.

When a member pays to attend another club’s pickup party, the attendance fee is nonrefundable after the cancellation deadline.

Event dates, prices, menus, benefits, and programming are subject to change.

Changes to Club Programs

Cougar may change club pricing, discounts, benefits, billing schedules, event dates, and shipping terms with at least 30 days’ notice.

Notice may be provided by email, website posting, or member newsletter.

Membership Conduct

Cougar may suspend or terminate a membership for nonpayment, fraud, misuse of benefits, abusive behavior, safety concerns, or violation of winery policies.

Any prepaid amount, account balance, or unclaimed wine remaining after an involuntary termination will be handled individually based on the circumstances.

Member Acknowledgment

By joining a Cougar club, I acknowledge that:

• I have read and understand this agreement.

• I have reviewed the current benefits and details of my selected club.

• I authorize Cougar Vineyard & Winery to keep my payment method on file and charge it according to my selected club’s billing schedule.

• I accept the commitment, cancellation, fulfillment, and payment terms that apply to my selected club.

• I understand that processed charges are nonrefundable except where required by law.
